By India Today News Desk: Congress leader Rahul Gandhi was on Friday disqualified as the Lok Sabha MP, a day after he was convicted and sentenced to two years in jail in a defamation case against his Modi surname remark in 2019.

In its order for Rahul Gandhi’s disqualification, the Lok Sabha stated the Congress leader stands disqualified from the membership of Lok Sabha from the date of his conviction, i.e. March 23, 2023.

Further, the notice stated the order was in terms of the provisions of Article 102(1)(e) of the Constitution of India read with Section 8 of the Representation of the People Act, 1951.

RAHUL GANDHI DEFAMATION CASE

The Surat court in Gujarat sentenced Rahul Gandhi to two years in jail in the case on Thursday.

The complaint against the Congress leader was filed by BJP MLA Purnesh Modi, over RaGa’s alleged remark, “How come all thieves have Modi as the common surname?”

The court of Chief Judicial Magistrate HH Varma, which held 52-year-old Gandhi guilty under Indian Penal Code (IPC) sections 499 and 500, also granted him bail and suspended the sentence for 30 days to allow him to appeal in a higher court.
